Terms of Service

1. Acceptance of Terms

By accessing and using Punchers, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Our Role as a Platform Provider

Important: Punchers is a platform that connects businesses with customers through digital punch cards. We facilitate this connection but are not directly responsible for:

  • The actual fulfillment of rewards or prizes offered by businesses
  • Refunds or exchanges related to business rewards
  • Disputes between businesses and customers regarding rewards
  • The quality or availability of business products or services

Business Responsibility: Each participating business is solely responsible for honoring their stated reward programs and maintaining their customer relationships.

3. Account Responsibilities

Account Security:

  • You are responsible for keeping your login credentials secure
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account

Appropriate Use:

  • Do not use the service for any illegal or unauthorized purpose
  • Do not attempt to manipulate punch card data or rewards
  • Do not create fake accounts or businesses
  • Businesses must provide accurate information about their reward programs

4. Limitation of Liability

Reward Redemption Disclaimer: We are not responsible for ensuring that businesses fulfill their stated reward programs. Any reward-related questions should be directed to the participating business.

To the fullest extent permitted by law, Punchers shall not be liable for:

  • Any loss, damage, or injury resulting from reward disputes between customers and businesses
  • Data access issues, service interruptions, or technical difficulties
  • Business losses resulting from use of this service
  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use

Service Provided "As Is": This service is provided "as is" without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Service Availability and Modifications

  • We strive to maintain service availability but cannot guarantee uninterrupted access
  • We may modify, suspend, or discontinue any part of the service at any time
  • We may update these terms periodically, with notice provided for significant changes
  • Continued use of the service after changes constitutes acceptance of new terms

6. Account Termination

By You:

  • You may delete your account at any time through your dashboard
  • Account deletion will remove all associated data
  • Pending punch cards may be affected by account deletion

By Us:

  • We reserve the right to suspend or terminate accounts for violations of these terms
  • We may terminate accounts for suspected fraudulent activity
  • We will provide reasonable notice when possible

7. Intellectual Property

The Punchers platform, including its design, functionality, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service without written permission.

8. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

Minimal Data Storage: We only collect data strictly necessary to run the platform, including user account credentials and punch card progress. No payment data, location data, or browsing behavior is collected or stored.

9. Dispute Resolution

First Contact Us: If you experience any issues with our service, please contact us at abdullah@mon10.org and we will attempt to resolve the matter promptly.

Business-Customer Disputes: For disputes related to rewards, products, or services, please contact the business directly. We can provide contact information but cannot resolve business-specific issues.

For legal disputes that cannot be resolved through direct communication, the parties agree that disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction where Punchers is based, without regard to its conflict of law principles.
